TERMS AND CONDITIONS OF ENTRY FOR SPALDING HOOPSFEST COMPETITION
1. These terms and conditions of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.
2. The entrant is responsible for ensuring his or her familiarity with the Terms at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of that restriction or of the Terms generally. All entrants acknowledge that the Promoter can rely on these Terms even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded a prize to an ineligible person. Return of a prize to the Promoter may be required by the Promoter if this occurs.
3. The promoter is GN Sports Pty Ltd, 28 Hudson Court, Keysborough, 3173 VIC ABN 68 069 922 970 (Promoter). The Promoter has the approval of the National Basketball League Pty Ltd ABN 65 164 187 937 of Level 6, 10 Queens Road Melbourne VIC 3004 (NBL) to run the Promotion.
PROMOTIONAL PERIOD
4. The competition commences once HoopsFest Fan Zone is open to the public on Thursday 19th September at 11am (AWST). Entry to the competition ends on Sunday 22nd September 2024 11.59pm (AWST) (Promotion Period). The winner will be notified after the end of the Promotion Period.
WHO CAN ENTER
5. Entry into the Giveaway is open to Australian residents only aged 13 years of age or older (entrants under 18 years of age, must have parent/guardian permission prior to entering) (Eligible Entrants), excluding:
(a) Management, employees, directors and contractors of the Promoter and the NBL, its related entities, and other agencies, firms or companies associated with the Promotion (including suppliers of the prizes).
6. The Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
7. If the entrant is under the age of 18 years old, they must have permission from a legal parent or guardian to enter and to receive the prize if they are the winner.
8. Entrants must be currently living in Australia to be eligible.
HOW TO ENTER
9. To enter and be eligible to win, an Eligible Entrant must, during the Promotion Period, complete their entry by scanning a QR code with their mobile device at the HoopsFest Fan Zone in Perth (September 19th-22nd 2024) that links to an entry form at spalding.com.au in accordance with these Terms (Eligible Entry).
ENTRY
10. To complete an Eligible Entry via spalding.com.au an Eligible Entrant must during the Promotion Period:
(a) Scan the QR code on a mobile device at the Spalding activation at the HoopsFest Fan Zone in Perth, Western Australia and,
(b) Fill in their details on the landing page at spalding.com.au, including: First Name, Surname, Email Address, Phone Number, State of Residence, Year of Birth and how many balls are in the cube.
10.1. Entrants are only able to enter once. The person who correctly guesses the exact number of balls will be the winner.
10.2. If 2 or more people correctly guess the exact number, a random draw generator will be conducted to select the major winner.
10.3. In the event that no one correctly guesses the right number, the closest guess will be deemed the winner.
10.4. Entrant must be an Australian resident with an Australian address.
10.5 Entrant must be able to accept the prize for the promotion.
ENTRIES GENERALLY
11. Eligible Entrants may only enter the Promotion in their own name and from their own email address (or their parent’s email address if under 18 years old).
12. Any costs associated with submitting an entry via spalding.com.au are the entrant’s responsibility.
13. The Promoter is not responsible for technical difficulties with the entry mechanisms and does not warrant that the entry mechanisms will be available at all times during the Promotion.
14. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render all entries submitted by that entrant invalid.
15. Incomplete, illegible, indecipherable or incorrect entries, or which contain offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win.
16. Entries are deemed to be received once uploaded to the specific promotional landing page on spalding.com.au.
WINNER DETERMINATION & PRIZE INFORMATION
17. Eligible Entries will be assessed based on their individual response and the number they have submitted to guess the balls to win. The entry which correctly guesses the exact number of balls will be the winner. If 2 or more people correctly guess the exact number, a random draw generator will be conducted to select the major winner at the completion of the Promotion Period by the Promoter and its representatives of Spalding Australia at 28 Hudson Court, Keysborough, 3173 VIC (Judging Location). The winner will be contacted by email and/or phone by [email protected]. We never ask for the credit card details of the winners.
(a) The winner will receive a basketball prize pack worth RRP $1,729.98:
- 1x Spalding EZ Assembly 54-Inch Acrylic Portable Basketball System RRP $1,099.99
- 1x Spalding HoopsFest Official Game ball Size 7 RRP: $149.99
- 4x GA tickets to an NBL game (of the winner’s choice, subject to availability) throughout the 2024-2025 Hungry Jack’s NBL Regular Season: RRP $480
(b) Each prize in the prize pack is not transferrable, exchangeable or redeemable for cash. If a prize is unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the Prize with a prize of equal or greater monetary value.
WINNER NOTIFICATION
18. The winner of the Promotion will be notified via email and/or phone within 72 hours of the relevant Judging Session.
19. If a winning Eligible Entrant does not respond to the Promoter’s notification within five (5) days, an alternative winner will be selected and contacted in the same process at that time and date. The alternative winner will be the person who has submitted an entry that is the closest to exact number of balls. Should there be more than one entry where this applies, a random draw generator will be conducted to select the alternative winner.
20. The Promoter takes no responsibility for a winning Eligible Entrant failing or neglecting to respond during the designated timeframe and consequently forfeits the Prize. The prize will be sent out within eight (8) weeks of the winning Eligible Entrant proving their postal address.
GENERAL
21. The Promoter may require an Eligible Entrant to provide proof of identity, proof of age and/or proof of residency. Identification considered suitable for verification is at the Promoter’s discretion. A prize will only be awarded following all verification requirements of the Promoter being met to its satisfaction.
22. The Promoter accepts no responsibility for any variation in the value of the prizes from the time of creating the Promotion or Promotional materials.
23. If more than one person attempts to claim a prize, the Promoter has sole and absolute discretion to determine which of those persons the winning entrant is.
24. Prizes, or components of prizes, are not transferable or exchangeable and cannot be taken as cash. If the winner’s chosen NBL game tickets are not available, they will be provided with tickets to an alternative Regular Season game.
25. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it including cancelling, terminating, modifying or suspending the Promotion.
26. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism or Promotion in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
27. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.
28. The Promoter, the Promoter's related entities, NBL and its related entities and all agencies associated with the Promotion shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of a prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
29. The prize winners must, at the Promoter's request, participate in any promotional activity (such as publicity and photography) relating to winning a prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material. This includes but is not limited to any of Spalding Australia’s and NBL’s social media channels.
30. CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the promoter reserves the right to seek damages to the fullest extent permitted by law.
PERSONAL INFORMATION
31. All information entrants provide (Personal Information) will be used by the Promoter for the purpose of conducting this Promotion.
32. The Promoter may disclose entrants' Personal Information to its contractors and agents to assist in conducting this Promotion, for future marketing or publicity use, and as required, to Australian regulatory authorities. The Promoter will share Personal Information with the NBL who may use and handle personal information in accordance with its privacy policy which is located at https://nbl.com.au/pages/privacy-policy.
33. The Promoter's and NBL’s treatment and storage of personal information will be handled in accordance with all applicable laws in Australia.
